To be eligible for the National prize, entry is open solely to residents of Australia. The eligibility for this prize depends on the postal code associated with the entrant’s residence.

To participate, contestants need to have a song uploaded to Unearthed prior to the competition ending at 11:59 PM on Sunday, 22nd.

The recipient will be selected by a jury of triple j professionals. The finalists will be chosen according to their capability to present an excellent live show appropriate for a NIMAs crowd in Darwin.

Extra Conditions for This Contest
As the victor, you’ll represent triple j at this occasion. Therefore, you must act responsibly and professionally and adhere to all guidelines and requirements set forth by both triple j and the event organizers.

General Terms and Conditions


In  Introduction

  1. Upon participating in the competition, you consent to adhere to the contest rules and conditions. These regulations encompass these general terms and conditions, the appendix attached to them, as well as any guidelines provided for the event on the organizer’s website.
  2. All terms written in uppercase within these General Terms and Conditions shall hold the meanings specified in the Schedule, except where explicitly noted otherwise. Should any discrepancies arise between this document and the Schedule associated with the Terms and Conditions,

  3. The promoter has the sole authority to decide whether to withhold any prize from an entrant failing to adhere to these terms and conditions. Additionally, they reserve the right to deny participation in any aspect of the reward should they determine that it would be unsuitable for the winner due to any circumstances.


Entry Restrictions

  1. To participate in the Competition, one must comply with the Entry Restrictions. Only individuals can enter this competition; companies or organizations are ineligible. Individuals who are directors, close relatives, staff members, or contractors of either the Promoter or any entities closely linked to the Competition’s organization and prize distribution cannot join in.


Competition Period

  1. The competition will take place throughout the duration of the competition period. Entries submitted after this period ends will not be considered valid. The organizers cannot be held responsible for any late, misplaced, delayed, or incorrectly directed submissions.


Entry Method

  1. To participate in the Contest, entrants must follow the specified Entry Method (along with any additional entry instructions provided by the Organizer on the Website) throughout the duration of the Contest period.


Maximum Number of Entries

  1. Participants may submit up to the Maximum Number of Entries for the competition. Each submission should be made independently and must comply with the criteria outlined in the Schedule, also adhering to the Entry Restrictions.


Judging Details

  1. The participant whose submission is deemed by the Promoter’s team of evaluators as both the most innovative and imaginative (along with any specific evaluation standards outlined in the Judging Details section of the Schedule) shall receive the prize. The Promoter along with its assessment committee reserves the right, at their sole discretion, to withhold any or all prizes, particularly when they deem an entry does not meet publishing quality benchmarks. Luck has no role in selecting the prizewinners. All decisions made by the Promoter and its judging panel are conclusive and must be adhered to by everyone entering the competition; thus, no discussions regarding these decisions will take place.


Prize

  1. The awarding of the prize will follow what’s detailed in the Schedule. The stated worth of these prizes reflects their suggested retail price according to the respective suppliers, they are quoted in Australian currency and were accurate when the competition period began. Please note that the promoter does not assume liability for any discrepancies in the prize value.


Prize Restrictions

  1. Unless stated differently in the Schedule, the Promoter won’t bear responsibility for any extra fees related to the usage of the Prize. The individual who wins the prize (along with their accompanying guests, should they have any) must cover all expenses linked to utilizing the Prize. This includes potential travel costs, meal and drink expenditures, insurance for both health and transit, as well as personal spending cash.
  2. Should a prize be accessible across multiple sites, the recipient can collect it solely at their closest major urban center. In case the award event takes place within the winner’s hometown, they won’t qualify for any accommodations or flights which might typically be included as part of the prize package.
  3. Should the Prize have specific redemption dates, the prize recipient must be available to claim the Prize on those specified dates set forth by the promoter. Should the prize recipient fail to collect the Prize on the designated day, the promoter reserves the right to select an alternate winner at their sole discretion.
  4. None of the prize components can be moved or exchanged for money.
  5. Each award is contingent upon availability. Should any awards or portions thereof become inaccessible because of factors outside the promoter’s reasonable management, the promoter retains the option to supply an equivalent item with equal or higher value than the initial reward, provided all relevant regulations and directives issued pursuant to official rules are adhered to.

  7. Should the prize include flights, participants consent to this arrangement.

a. the Prize does not include transfers to and from the winner’s place of residence to the departure point and transfers between the accommodation and airport (unless otherwise specified in the Schedule);

b. the flights have to be used simultaneously, for identical travel dates, to and from the exact destination;

c. Frequent flyer (or similar reward program) points will not accumulate for the prize winner (as well as any guest using the prize) on the flights or accommodations included in the prize; and

d. The timing for flight bookings will be at the sole discretion of the Promoter, with potential blackout periods possibly applying, which could include all public holidays.

  1. If the Prize includes accommodation, it is a condition of accepting the Prize that the Prize winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all ancillary costs they may incur during their stay. For the avoidance of doubt, the Prize winner acknowledges that the accommodation part of the Prize includes room charges only (and no ancillary costs such as room service).
  2. If the Prize involves tickets to an event, the Promoter is not responsible for any changes in times or dates, or cancellations or rescheduling of events that may prevent the Prize winner from redeeming the Prize or any part of it.


Winner Notification

  1. Should there be no additional advertising, the prize winners will receive notifications following the guidelines outlined under ‘Winner Notification’ within the Schedule section. Kindly anticipate up to twenty-eight (28) days from receiving your notification letter for the arrival of your prize.


Rights in Your Entry

  1. Unless otherwise specified in the Schedule, all physical entries become the property of the Promoter and will not be returned to the entrants.
  2. In order to qualify for a prize, your submission should solely consist of content crafted by yourself or materials for which you have obtained usage rights, potentially incorporated into your entry.
  3. Upon submission of your entry to the Promoter, you grant both the Promoter along with its licensed entities and assigns:

a. the Rights in Your Submission outlined in the Schedule allowing full access to exploit all rights related to your submission, which includes but is not limited to reproducing and distributing your submission publicly worldwide at any time and through various mediums indefinitely; and

b. the right to promote, air, and share with the general audience your name, character, image, or voice for any promotional purposes related to the Competition without additional payment to you for these uses.

  1. You acknowledge and consent to the fact that your submission can be modified or altered at any time by the Promoter due to legal, editorial, or operational requirements.
  2. As a condition of accepting the Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.


ABC Material

  1. If the way of entering requires you to include any materials owned by the Promoter,

b. you cannot conduct a business using a name that incorporates the ABC Material or any trademark similar to the ABC Material; and

c. you must not file for registration of a trade mark that is similar to ABC Material.

  1. The promoter will gather your personal data to manage the competition. General

  1. Any effort to disrupt the regular operations of the Website or to compromise the fair conduct of this Competition is forbidden and will result in making all submissions from that participant null and void.
  2. You warrant that:

a. your submission consists of original content created by you, and wherever this is not the case, you have acquired the necessary permissions;

b. all information supplied with your submission is correct and precise;

c. you possess all the required permissions needed to grant the Promoter the rights outlined in these Terms and Conditions;

d. utilization of your submission by the Promoter, as outlined in these Terms and Conditions, will not violate the rights of any third parties; and

Your submission must comply with all laws.

  1. You agree to protect the promoter from any losses or damages arising from a violation of the warranties mentioned earlier, and recognize that the promoter has the right, at their sole discretion, to withhold the prize from you should they find these warranties have been breached.
  2. You understand that the Promoter has no duty to utilize your submission, and they may choose whether to reproduce and publicly share your contribution according to these terms and conditions. This decision rests entirely with the Promoter.
  3. You recognize that this competition is not in any way sponsored, endorsed, or managed by, nor affiliated with, Facebook. Should you have any queries, feedback, or concerns about the competition, they should be addressed to ABC via the website instead of being directed to Facebook.
  4. Should any occurrence impede or obstruct the Promoter from running the Competition or delivering the prize to the winners, the Promoter reserves the right, at their sole discretion, to annul the competition and restart it later with the same terms and conditions.
  5. The Promoter is not liable for any erroneous or imprecise details, issues with equipment or software used in the Competition, or any technical glitches encountered during the management of the competition. They do not take responsibility for errors, omissions, interruptions, deletions, defects, delays, communication failures, stolen data, damage, unauthorized access, or alterations made to submissions.
  6. In accordance with the law, the Promoter holds no responsibility for any delays, deaths, injuries, damages, costs, or losses—be they direct or indirect—to individuals or properties arising from participation in the Competition or acceptance and use of any Prize. This includes but is not limited to failed delivery of Prizes or harm sustained during shipping; additionally, the Promoter assumes no liability due to Prize winners failing to adhere to rules set forth by any third parties involved.
